These Terms of Service (“Terms”) govern your access to and use of tryrovix.co (the “Site”), including purchases of Rovix products and your use of any related services, features, content, or customer support (collectively, the “Services”).

The Services are operated by:

In these Terms, “Rovix,” “we,” “us,” and “our” refer to MASAFR LLC.

By visiting the Site, purchasing a product, or otherwise using the Services, you agree to these Terms and our incorporated policies. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old or the age of legal majority in your state of residence to make a purchase.

If you are under the applicable age of majority, you may use the Services only with the involvement and permission of a parent or legal guardian.

By using the Services, you represent that you have the legal capacity to enter into a binding agreement.

2. United States Sales Only

Rovix currently sells and ships products only within the United States.

We reserve the right to refuse or cancel orders placed for delivery outside the areas we serve. Product availability, delivery options, and shipping times may vary by location.

3. Account and Customer Information

Certain features may require you to create an account or provide contact, payment, billing, and shipping information.

You agree to:

  • Provide accurate, current, and complete information;

  • Keep your information updated;

  • Maintain the confidentiality of your login credentials, if applicable;

  • Accept responsibility for activity conducted through your account; and

  • Notify us promptly if you suspect unauthorized access or use.

We are not responsible for losses caused by your failure to protect your account credentials, except where responsibility cannot legally be excluded.

4. Products and Product Information

We make reasonable efforts to display product descriptions, specifications, features, colors, dimensions, images, and prices accurately.

However:

  • Product colors may appear differently depending on your screen;

  • Images may include staging, digital renderings, or accessories not included with the product;

  • Packaging and minor product details may change;

  • Measurements and technical information may be approximate; and

  • Product availability may change without notice.

You are responsible for reviewing the product description, compatibility information, dimensions, instructions, and warnings before purchasing or using a Rovix product.

We reserve the right to modify or discontinue any product or feature without notice, subject to our obligations concerning orders already accepted.

5. Smartwatch and Fitness Information

The Rovix Smartwatch may provide wellness, activity, fitness, sleep, heart-rate, or similar information.

Unless expressly stated otherwise, the Rovix Smartwatch:

  • Is a general consumer wellness product;

  • Is not a medical device;

  • Is not intended to diagnose, treat, cure, prevent, or monitor any disease or medical condition;

  • Is not a substitute for professional medical advice, diagnosis, treatment, or emergency care; and

  • Should not be used as the sole basis for medical or safety-related decisions.

Measurements and estimates may be affected by fit, movement, skin contact, environment, device settings, software, and other factors. Results may not always be complete or accurate.

Consult a qualified healthcare professional regarding medical symptoms or concerns. In an emergency, contact emergency services immediately.

6. Water-Resistance Notice

The Rovix Smartwatch has an IP68 water-resistance rating under controlled testing conditions. IP68 does not mean that the product is completely waterproof under all circumstances.

Water resistance may decrease over time because of ordinary wear, impact, temperature changes, deterioration of seals, or improper use.

Unless the product instructions expressly state otherwise, do not use the smartwatch:

  • While swimming or diving;

  • In a shower, sauna, or steam room;

  • In hot water;

  • In seawater or chlorinated water;

  • During high-pressure water activities; or

  • Outside the conditions stated in the product instructions.

Damage caused by using the product outside its stated water-resistance conditions may not be covered by the limited warranty.

7. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An order-confirmation email acknowledges that we received your order. It does not necessarily mean that the order has been finally accepted.

We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability;

  • Pricing or description errors;

  • Payment-authorization failure;

  • Suspected fraud or unauthorized activity;

  • Incorrect or incomplete customer information;

  • Orders placed for resale or other unauthorized commercial purposes; or

  • Inability to deliver to the submitted address.

If we cancel an order after payment has been authorized or collected, we will refund the canceled amount to the original payment method.

We may limit quantities purchased per customer, household, order, payment method, or shipping address.

8. Order Changes and Cancellations

Orders begin processing shortly after submission. Therefore, orders cannot be changed or canceled after they have been submitted.

Please check the product, quantity, email address, billing information, and shipping address carefully before completing checkout.

After receiving an order, you may request an eligible return in accordance with our Refund, Return, and Warranty Policy.

Nothing in this section limits rights that cannot be waived under applicable law, including rights that may arise if we cannot ship an order within the promised timeframe.

9. Prices, Taxes, and Payment

Prices are displayed in US dollars unless stated otherwise.

Applicable taxes, shipping costs, and other charges will be shown during checkout before you submit the order.

Prices and promotions may change without notice. A price change will not normally affect an order that has already been accepted.

You agree to provide valid payment information and authorize us and our payment providers to charge the total amount shown at checkout.

If we discover an obvious pricing, promotional, or product-description error, we may:

  • Contact you for instructions;

  • Cancel the affected order; and

  • Refund any amount already paid for the canceled product.

We are not required to fulfill an order at an obviously incorrect price where cancellation is permitted by law.

10. Promotions and Discount Codes

Promotions, discount codes, free gifts, and special offers may be subject to separate conditions displayed with the offer.

Unless otherwise stated:

  • Promotions cannot be combined;

  • Discount codes have no cash value;

  • Discounts apply only during the stated promotional period;

  • Promotions cannot be applied retroactively;

  • Free promotional items cannot be exchanged for cash; and

  • We may cancel or modify a promotion where permitted by law.

We may reject the use of a promotion where there is evidence of fraud, technical manipulation, duplicate use, or violation of the promotional conditions.

11. Shipping and Delivery

Delivery estimates are estimates and are not guaranteed unless we expressly state otherwise.

Delivery may be affected by:

  • Carrier delays;

  • Weather;

  • Holidays;

  • High order volumes;

  • Incorrect or incomplete addresses;

  • Security reviews;

  • Events outside our reasonable control; or

  • Other operational circumstances.

If shipment is delayed beyond the stated or legally permitted timeframe, we will provide any notice, cancellation opportunity, or refund required by applicable law.

Customers are responsible for providing a complete and accurate shipping address. Contact support@tryrovix.co immediately if you discover an error. We cannot guarantee that an address can be changed after an order is submitted.

Additional shipping charges may apply if an order is returned because the customer supplied an incorrect or incomplete address.

Questions concerning delayed, missing, or damaged packages are handled in accordance with our Refund, Return, and Warranty Policy.

12. Returns, Refunds, and Warranty

Returns, refunds, replacements, delivery claims, and warranty claims are governed by our separate Refund, Return, and Warranty Policy, which is incorporated into these Terms.

Important conditions include:

  • A 30-day return period beginning on the delivery date;

  • A requirement to report visibly damaged, incomplete, or incorrect deliveries within seven days;

  • Customer-paid return shipping for change-of-mind returns;

  • A $10 restocking fee for eligible change-of-mind returns;

  • Rovix-paid return shipping for verified damaged, defective, or incorrect products; and

  • A 90-day limited warranty beginning on the delivery date.

The complete policy should be reviewed before purchasing.

If these Terms conflict with the Refund, Return, and Warranty Policy regarding a return, refund, or warranty claim, the more specific Refund, Return, and Warranty Policy will control.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

13. Proper Product Use

You agree to use Rovix products only:

  • For their intended purpose;

  • In accordance with supplied instructions and warnings;

  • With compatible chargers, accessories, and devices; and

  • In compliance with applicable laws.

You must not intentionally perform destructive, dangerous, or extreme tests on a product.

Damage caused by misuse, unauthorized modification, incompatible accessories, excessive force, improper charging, or failure to follow instructions may not qualify for a return, replacement, refund, or warranty service.

14. Acceptable Use of the Services

You may use the Services only for lawful personal purposes.

You must not:

  • Use the Services for unlawful, fraudulent, abusive, or deceptive activity;

  • Violate the rights of Rovix or another person;

  • Submit false return, refund, delivery, or warranty claims;

  • Attempt product substitution or return a different product;

  • Interfere with the Site’s security or operation;

  • Introduce malware, viruses, or harmful code;

  • Scrape, copy, or extract Site content using automated tools without permission;

  • Attempt to access accounts, systems, or data without authorization;

  • Circumvent purchase limits or security measures;

  • Use the Site to send spam or malicious communications; or

  • Use Rovix content, trademarks, or materials for unauthorized commercial purposes.

We may restrict or terminate access to the Services if we reasonably believe these Terms have been violated.

15. Intellectual Property

The Site and its contents—including the Rovix name, logos, product images, graphics, designs, videos, text, software, layout, and other materials—are owned by or licensed to MASAFR LLC and are protected by applicable intellectual-property laws.

We grant you a limited, personal, nonexclusive, nontransferable, and revocable right to access and use the Site for lawful personal shopping purposes.

You may not reproduce, distribute, modify, publish, sell, license, create derivative works from, or commercially exploit our content without prior written permission.

No ownership rights are transferred to you through your use of the Services.

16. Reviews and User-Submitted Content

If you submit a review, photograph, video, testimonial, comment, suggestion, or other content, you represent that:

  • You own the content or have permission to submit it;

  • The content is accurate and based on your genuine experience;

  • The content does not infringe another person’s rights;

  • The content is not unlawful, deceptive, threatening, defamatory, or obscene; and

  • You have disclosed any material relationship or incentive connected to the content where required.

You grant Rovix a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, and distribute the submitted content for operating, improving, and promoting Rovix and its products.

This license does not override rights granted to you under applicable privacy law. Personal information contained in submitted content will be handled according to our Privacy Policy.

We may remove or decline to publish content, but we are not obligated to monitor all submissions.

17. Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, applications, payment providers, social-media platforms, or other services.

Third parties operate under their own terms and privacy practices. Rovix is not responsible for third-party content, availability, security, products, or practices.

A link or integration does not necessarily mean that Rovix endorses the third party.

18. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy, which is incorporated into these Terms.

By using the Services, you acknowledge that you have reviewed the Privacy Policy.

19. Electronic Communications

When you place an order, contact us, or use the Services, you consent to receive transactional communications electronically, including order confirmations, shipping updates, policy notices, and customer-support messages.

Transactional communications are not promotional marketing messages.

If you separately choose to receive marketing communications, you may unsubscribe according to the instructions included in those communications.

20. Disclaimer of Warranties

Except for the express 90-day limited warranty described in our Refund, Return, and Warranty Policy, and to the fullest extent permitted by law, the Site and Services are provided on an “as available” basis.

To the fullest extent permitted by law, we disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not guarantee that:

  • The Site will always be available, uninterrupted, secure, or error-free;

  • Every error will be corrected;

  • Site content will always be complete or current; or

  • A product will satisfy a purpose not expressly stated in the product description.

Some states do not permit certain warranty exclusions. In those states, these exclusions apply only to the extent legally permitted.

Nothing in this section limits the express 90-day limited warranty or any rights that cannot legally be waived.

21. Limitation of Liability

To the fullest extent permitted by law, MASAFR LLC and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or connected with the Services or products.

To the fullest extent permitted by law, our total liability for a claim relating to a purchased product will not exceed the amount you paid for the product giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, which may include liability for fraud, willful misconduct, or certain personal injuries.

Some jurisdictions do not allow particular liability limitations. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold MASAFR LLC harmless from third-party claims, damages, liabilities, and reasonable costs arising directly from:

  • Your unlawful use of the Services;

  • Your intentional violation of these Terms;

  • Content you submit that infringes another person’s rights; or

  • Fraudulent or abusive activity conducted through your account.

This section does not require you to indemnify Rovix for its own negligence, unlawful conduct, or breach of these Terms.

23. Events Outside Our Control

We will not be responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, carrier interruptions, labor disputes, government actions, internet failures, supply disruptions, public-health emergencies, or similar events.

This section does not eliminate any refund, cancellation, or other consumer right required by applicable law.

24. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Subject to applicable consumer-protection laws, legal proceedings relating to these Terms or the Services must be brought in a state or federal court located in New York County, New York.

Nothing in this section prevents a customer from exercising rights that cannot legally be waived under the laws of the customer’s state of residence.

25. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent legally permitted.

The remaining provisions will remain in effect.

26. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

Any waiver must be in writing and authorized by MASAFR LLC.

27. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

We may assign these Terms as part of a merger, acquisition, sale, restructuring, or transfer of our business or assets, subject to applicable law.

28. Entire Agreement

These Terms, together with our Privacy Policy and Refund, Return, and Warranty Policy, constitute the agreement between you and MASAFR LLC concerning the Services.

They replace prior communications or understandings concerning the same subject matter.

29. Changes to These Terms

We may update these Terms to reflect changes in our Services, products, business practices, or legal obligations.

Updated Terms will be posted on the Site with a revised “Last updated” date. Changes will apply prospectively unless applicable law permits otherwise.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
